1. About us and these terms
This website is operated by Austine Realtors Ltd, a real estate agency in Kenya (Nairobi, Kenya). By using the website or sending us a request you agree to these terms. If you do not agree, please do not use the website.
2. Property listings
- Listings are based on information from property owners, landlords and developers. We take reasonable care to keep them accurate and up to date, but we cannot guarantee that every detail is complete or current.
- Prices are in Kenya Shillings (KES) unless stated otherwise and may change without notice. Unless a listing says so, prices do not include stamp duty, legal fees, service charges, deposits, utilities or other costs.
- Photos, videos, floor areas and plans are for guidance. Off-plan developments may change before completion.
- A listing is an invitation to enquire, not an offer that can be accepted. Properties remain subject to availability, contract and the owner’s approval.
- Before you commit, inspect the property and make your own checks — such as an official land search, verifying title and approvals, and getting independent legal and valuation advice.
3. Viewings, tours and enquiries
- A booking made on the website is a request. It is confirmed only when one of our agents contacts you to agree the date and time.
- Viewings arranged through us are free of charge.
- Please give accurate contact details and let us know as early as possible if you need to change or cancel.
- We may decline or reschedule a request, for example if the property becomes unavailable or the owner is not able to host a viewing.
- Please follow the agent’s directions during a viewing and take care of yourself and any children with you on site.
4. Fees, payments and fraud warning
Any commission or fee for our services is agreed with you in writing before it applies. Payments for a property — such as deposits, rent or purchase price — must only be made through the channels set out in your written agreement, and you should always get an official receipt.
Protect yourself: we will never ask you to pay a viewing fee or send money to a personal M-Pesa number or personal bank account. If anyone claiming to represent Austine Realtors Ltd asks you to do so, do not pay — contact us first on +254704350354.
5. Using the website
You agree not to:
- use the website for anything unlawful, fraudulent or misleading, or give false information in a request;
- copy, scrape or harvest listings or contact details by automated means;
- attempt to gain unauthorised access to, interfere with or overload the website or its systems; or
- impersonate another person or misrepresent your connection with anyone.
Misuse may be reported to the authorities, including under the Computer Misuse and Cybercrimes Act, 2018.
6. Content and intellectual property
The website and its content — including text, photos, videos, the Austine Realtors Ltd name and logo — belong to us or to the people who licensed them to us, and are protected by the Copyright Act and other laws. You may view and share links to listings for personal use, but you may not copy or republish the content without our written permission.
7. Third-party services and links
The website links to or embeds services we do not control, such as WhatsApp, Google Maps, YouTube and social networks. Their own terms and privacy policies apply when you use them, and we are not responsible for their content or availability.
8. Our responsibility to you
We provide the website with reasonable skill and care, but we do not promise it will always be available or error-free. To the extent the law allows, we are not liable for losses arising from reliance on listing information you have not verified, from decisions you make without independent advice, or from events outside our reasonable control.
Nothing in these terms limits or excludes any rights you have as a consumer under the Consumer Protection Act, 2012 or any liability that cannot be limited by law.
9. Privacy
We handle your personal data as described in our Privacy policy and in line with the Data Protection Act, 2019.
10. Changes
We may update these terms from time to time. The version on this page, with its “last updated” date, applies to your use of the website from that date.
11. Governing law and disputes
These terms are governed by the laws of Kenya. If you have a complaint, please contact us first and we will try to resolve it within 30 days. Any dispute we cannot resolve together may be referred to mediation or to the courts of Kenya.
